1. Scope of Application
The following General Terms and Conditions (GTC) apply to the use of this website and the business relationships between Simply Soup GmbH, Hallwylstrasse 24, 8004 Zurich (hereinafter SIMPLY SOUP) and its customers, in the version currently available and valid when accessing the website or placing an order.
A customer is defined as any natural or legal person who maintains business relations with SIMPLY SOUP. These GTC may be subject to adjustments from time to time. SIMPLY SOUP requests that you read these provisions carefully before each order.
These GTC apply exclusively. Conflicting, supplementary, or deviating terms from these GTC require the express written confirmation of SIMPLY SOUP to be valid. By using this website or placing an order, the customer confirms full acceptance of these GTC, including delivery and payment terms.
Should individual provisions of these GTC prove to be or become invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.
The operator of this website is Simply Soup GmbH (Imprint).
2. Information on this Website
SIMPLY SOUP contains information about products and services. Price and assortment changes as well as technical modifications are reserved. All information on www.simplysoup.ch (product descriptions, illustrations, films, dimensions, weights, technical specifications, accessory relationships, and other details) are to be understood only as approximate values and do not constitute an assurance of properties or guarantees, unless explicitly stated otherwise. SIMPLY SOUP strives to provide all information on this website correctly, completely, up-to-date, and clearly, but SIMPLY SOUP cannot guarantee this either expressly or implicitly.
All offers on this website are non-binding and are not to be understood as a binding offer.
3. Prices
Unless otherwise stated, SIMPLY SOUP’s prices include the statutory value-added tax. Prices are net in Swiss Francs (CHF).
Any shipping costs, unless otherwise specified, will be charged additionally and must be paid by the customer. Shipping costs are shown separately during the order process.
Technical changes, errors, and misprints are reserved; in particular, SIMPLY SOUP may make price changes at any time and without prior notice. Consulting and support services are not included in the sales prices.
4. Conclusion of Contract
The offers on this website represent a non-binding invitation to the customer to order products and/or services from SIMPLY SOUP. By placing an order via this website, including the acceptance of these GTC, the customer submits a legally binding offer to conclude a contract. SIMPLY SOUP then sends an automatic “order confirmation” by email, which confirms that the customer’s offer has been received by SIMPLY SOUP. Orders placed are binding for the customer. Unless otherwise stated, there is no right of return or withdrawal.
The contract is concluded as soon as SIMPLY SOUP sends an acceptance declaration by email, confirming the dispatch of the ordered products or services.
Orders will only be delivered after full payment has been received and provided the goods are available. If, after the conclusion of the contract, it turns out that the ordered goods cannot be delivered or cannot be delivered in full, SIMPLY SOUP is entitled to withdraw from the entire contract or a part of the contract. Should the customer’s payment already have been received by SIMPLY SOUP, the payment will be refunded to the customer. If no payment has yet been made, the customer will be released from the payment obligation. In the event of contract termination, SIMPLY SOUP is not obliged to provide a replacement delivery.
5. Payment Options
The following payment methods are available at SIMPLY SOUP:
TWINT
You pay the invoice amount via TWINT. Further information will be provided during the order process.
PayPal
You pay the invoice amount via the online provider PayPal. You must generally be registered there or register first, authenticate with your access data, and confirm the payment instruction to us (exception: guest access, if applicable). Further information will be provided during the order process.
Visa / Mastercard / American Express
You pay the invoice amount via Visa, Mastercard, or American Express through the provider Payrexx. Further information will be provided during the order process.
Postcard / Post E-Finance
You pay the invoice amount via Postcard or Post E-Finance through the provider Payrexx. Further information will be provided during the order process.
5. Delivery
Deliveries are sent by courier service to the address specified by the customer in the order. Deliveries take place on Fridays between 11:00 AM and 2:00 PM. Invoicing is done by email.
If the delivery cannot be delivered or the customer refuses to accept the delivery, SIMPLY SOUP may terminate the contract after sending a notice of complaint by email to the customer and setting a reasonable deadline, and charge for the incurred expenses.
6. Liability
SIMPLY SOUP excludes all liability, regardless of its legal basis, as well as claims for damages against SIMPLY SOUP and any auxiliary persons and vicarious agents. In particular, SIMPLY SOUP is not liable for indirect damages and consequential damages, lost profits, or other personal, property, and pure financial damages of the customer. Further mandatory legal liability remains reserved, for example, for gross negligence or unlawful intent.
SIMPLY SOUP uses hyperlinks solely for the customer’s simplified access to other web offerings. SIMPLY SOUP cannot know the content of these web offerings in detail, nor can it assume liability or other responsibility for the content of these websites.
7. Other Provisions
SIMPLY SOUP expressly reserves the right to change these GTC at any time and put them into effect without prior notice.
In the event of disputes, Swiss substantive law shall apply exclusively, to the exclusion of conflict-of-law rules. The UN Convention on Contracts for the International Sale of Goods (CISG, Vienna Sales Convention) is explicitly excluded.
The place of jurisdiction is the registered office of Simply Soup GmbH, unless the law provides for mandatory places of jurisdiction.
